The Burundi judiciary comprises of the Supreme Court, Tribunals of First Instance and Constitutional Courts. The judicial system in Burundi is based upon the French and German customary law. Bujumbura, the capital city of Burundi, is home of the Supreme Court and Court of Appeal of Burundi. Presently, the president of the Supreme Court of Burundi is Adrien Nyankiye. The Burundi Supreme court consists of nine members including the president. The magistrates of this higher authority are recruited on the basis of experience and seniority.
The Supreme Court is divided into three chambers, namely, administrative chamber, judicial chamber and chamber of cassation. The united chambers of the court monitor the rules of the judicial chamber and any other chamber belonging to Supreme court or any other body holding the same rank.
The High Court of Burundi judiciary constitutes the Supreme Court as well as the Constitutional Court. It is responsible for sentencing the Prime Minister or the President of Burundi for any crime during their tenure.
In the year 1992, the constitution of Burundi introduced a number of courts for reviewing all the newly made laws. A special constitutional court was being made to monitor that all the laws strictly adhere to the Constitution of Burundi. The military court of Burundi was responsible for sentencing military officials involved in criminal activities. In 1996, the military personnel disregarded the constitution and made it an independent judicial system.
